Report: Walmart Mounting Another Push To Sell Spirits In Texas

June 30, 2021

Walmart is reportedly renewing its effort to sell spirits in the Lone Star State. The retail giant is filing a lawsuit in state district court in Austin challenging the Texas law that prohibits publicly traded retailers from selling spirits, according to the Dallas Morning News.

Walmart won a victory in the battle in 2018, when U.S. District Judge Robert Pitman agreed with its complaint that the Texas law is discriminatory, only to see the decision overturned on appeal the next year. Walmart’s petition to the Supreme Court in that prior effort was also rebuffed. Now the company will take another swing at entering the Texas market for spirits, which is the third-largest nationwide in volume terms, according to Impact Databank, after California and Florida.
