California Judge Issues Mixed Ruling In Delivery Case
November 24, 2020In a closely watched case, Fresno County Superior Court judge Rosemary McGuire has largely let the status quo stand in California’s cannabis delivery market. Brought by a group of 24 cities and Santa Cruz county, the suit sought to prevent delivery providers from operating in their locales. While local California governments may ban dispensaries within their borders, delivery is permitted everywhere under state regulations.
In her ruling, McGuire agreed with the state Bureau of Cannabis Control, which said that its regulation doesn’t stop local governments from banning delivery in their area, but that those local governments must enforce any such ban. “On the basis of that conclusion, the court finds that this matter is not ripe for adjudication, and dismisses the action as to all plaintiffs,” McGuire concluded.—Daniel Marsteller
