Florida, Missouri Eye Restrictions On Hemp-Derived THC Products

State legislatures in both Florida and Missouri have made moves toward restricting the sale of hemp-derived cannabis products with enough THC to cause intoxication. The move comes amid a period of expansion and industry interest in hemp-derived THC products, which were inadvertently legalized nationally under the 2018 Farm Bill.

In Florida, the state senate passed SB 1698, banning delta-8 THC as well as limiting the amount of hemp-derived THC permissible in products sold in the state. The bill, which received bipartisan support, limits individual servings to 2mg of THC and entire packages to 10mg total.

Additionally, the bill creates restrictions on packaging hemp-derived THC products sold in Florida, with the senate mandating that products not appeal to children, including banning products that resemble existing snacks or candies. The bill is now up for a vote in the Florida house of representatives.

Missouri lawmakers, on the other hand, are debating how to regulate the sales of hemp-derived THC beverages, as well as restrictions on packaging, similar to those seen in Florida. Currently, Missouri does not have a regulatory body governing hemp-based THC products. A new bill sponsored by state senator Nick Schroer and state house representative Chad Perkins would place hemp-derived THC products under the purview of the Missouri Department of Health and Senior Services.

The issue raised by opponents of the bill is that by placing the products under the control of DHSS, the law would restrict their sales to state-licensed dispensaries, cutting out gas stations, convenience stores, and other retailers, through which such products have been rapidly expanding in a number of states.—Shane English
