Report: FTC Lawsuit Targeting Kroger-Albertsons Deal Could Come This Week

February 27, 2024

The long-simmering $25 billion tie-up between two of the largest grocery chains in the U.S. could be in the crosshairs of a lawsuit from the Federal Trade Commission (FTC) as soon as this week, Bloomberg reported. Last month, Kroger and Albertsons announced another delay to closing the proposed deal, which had been scheduled to finalize early this year, as they continued to work through potential competition issues with the FTC.

But with an agreement between the FTC and the merger partners not to close the deal expiring February 28, Bloomberg reported that the FTC could file suit to halt the transaction ahead of that date. The proposed Kroger-Albertsons merger is already facing lawsuits from the states of Colorado and Washington aimed at quashing the deal due to competition concerns.—Daniel Marsteller
