Provi’s Case Against Top Wholesalers Set To Proceed

Online beverage marketplace Provi has won a round in its lawsuit against top wine and spirits wholesalers Southern Glazer’s and RNDC, as a federal judge yesterday denied the distributors’ motion to dismiss.

Provi initially lodged its federal antitrust complaint against the two wholesalers in Illinois in 2022, alleging that they illegally curbed Provi’s attempts to provide a third-party ordering platform for retailers in an effort to thwart competition in the e-commerce market.

In yesterday’s ruling Judge Nancy L. Maldonado found Provi’s complaint sufficient to move forward with the case, which will now proceed to the discovery phase. Both Southern Glazer’s and RNDC have said the claims are baseless and that they intend to vigorously defend against the suit.—Daniel Marsteller
