Kroger-Albertsons’ $25B Merger Blocked By Federal, State Judges

In case you missed yesterday’s news alert, the long-simmering $25 billion merger between supermarket giants Kroger and Albertsons was blocked in federal court in Oregon yesterday, with U.S. District Judge Adrienne Nelson issuing a temporary injunction. Nelson agreed with the FTC’s position that the tie-up would reduce competition and raise prices for consumers. The FTC sued to stop the merger from proceeding in February, citing the potential of higher prices for consumers and lower wages for workers.

About an hour after Nelson’s decision was released, a Washington state court judge likewise ruled against the merger, agreeing that the move would stifle competition. Kroger said in a statement that it’s disappointed in the rulings and is weighing its options as to the path forward to completing the deal.
