Hemp-Derived THC Faces New Challenges In California And Kentucky
March 18, 2025Hemp-derived THC products continue to face state government scrutiny, with California extending its wholesale ban on intoxicating hemp products by 90 days and Kentucky taking a cautious approach to legalizing the category.
In California, Governor Newsom’s ban on intoxicating hemp products is set to be extended on March 24. The 90-day extension maintains the status quo: hemp products are restricted to consumers over 21 years old and cannot contain any THC or intoxicating chemicals. After the 90-day period, the state can extend it for an additional 90 days before it will be forced to pass legislation to approve or ban hemp-derived THC.
In Kentucky, lawmakers are taking a more measured approach, allowing limited legal sales while the state commissions a report from the University of Kentucky on the products. The move is an about-face for the state, where last week state senator Julie Raque Adams introduced a bill to ban the products until after the study was complete. The modified bill will allow for sales in the interim, with a maximum potency of 5mg of THC per beverage. While the modified bill has found support in the state senate, it still needs to pass in the state’s house and receive Governor Beshear’s signature before becoming law.—Shane English
