Federal Court Allows Tariffs To Continue Pending Appeal
June 11, 2025The U.S. Court of Appeals for the Federal Circuit in Washington, D.C. has allowed the Trump administration’s so-called “reciprocal” tariffs to remain in effect as the court examines a lower court decision that had struck the tariffs down. Arguments in the case are scheduled for July 31.
This is only one of several court cases currently proceeding in which the administration’s authority to levy tariffs under the International Emergency Economic Powers Act (IEEPA) has been challenged. After announcing sweeping tariffs covering a broad range of countries in early April, the administration paused most levies for 90 days as it negotiates with trading partners, although a 10% “baseline” tariff on all imports remains in effect.—Daniel Marsteller
