Diageo Seeks to Dismiss Tequila Lawsuit

Diageo has petitioned the U.S. District Court, Eastern District of New York with a proposed schedule to dismiss the lawsuit concerning additives use in its Tequila brands. In a letter addressed to judge DeArcy Hall, the company sought permission to file to dismiss the lawsuit on October 31, 2025. In turn, the plaintiffs would have until December 1 to file their opposition with Diageo’s reply due by December 15. In the letter, Diageo’s lawyers write, “Because plaintiffs’ allegations are false, highly inflammatory, and risk confusing distributors, retailers, and consumers in the marketplace, Diageo respectfully requests leave to file its briefs on the public docket as they are served on plaintiffs.”

Commenting on the veracity of the lawsuit’s claims, a Diageo spokesperson said, “These claims are without factual or legal merit. The complaint fails to allege a single fact that comes close to supporting the baseless claim that Casamigos and Don Julio Tequilas are not 100% agave. All Casamigos and Don Julio tequilas labeled as “100% agave” are made from 100% Blue Weber agave. We will vigorously defend the quality and integrity of our Tequilas in court, and against anyone who is spreading misinformation and lies about our products.”—Shane English
