Supreme Court Petitioned To Hear Challenge To Federal Prohibition

A group of Massachusetts-based THC companies has petitioned the Supreme Court, asking the Justices to consider their challenge to federal cannabis prohibition. The companies—Canna Provisions, Gyasi Sellers, Wiseacre Farm, and Verano Holdings—are asking the Court to reconsider the ruling in Gonzales v. Raich which authorized the federal government to crack down on cannabis production in California using the Commerce Clause.

The companies argue that allowing the federal government to use laws governing interstate commerce to regulate intrastate commerce is an overreach of federal power. In order for the case to end up in front of the Supreme Court, four of the nine justices must approve it. If they decline to review the case, the companies’ lawsuit will have failed, as the group has lost in two lower courts.—Shane English
