October 23, 2023•The Federal Trade Commission (FTC) is taking retail giant Total Wine & More to federal court to enforce an administrative subpoena seeking information pertaining to the agency’s ongoing antitrust investigation into Southern Glazer’s Wine & Spirits. The FTC’s petition asks the U.S. District Court for the Eastern District of Virginia to order the retailer to explain why it shouldn’t be required to comply with its demand. Otherwise, the FTC wants the court to order Total Wine to produce certain documents and information within 20 days. The FTC says the information is necessary to determine whether Southern Glazer’s offered certain advantages to large retailers like Total Wine that weren’t available to smaller retailers.
