DEA Pushes Rescheduling Hearing Until Post-Election
September 3, 2024The proposed rescheduling of cannabis could be delayed until after the inauguration of the next president, as the Drug Enforcement Agency (DEA) has scheduled an administrative hearing on the subject for December 2. The DEA says the hearing is in response to a large volume of requests it received for additional information gathering on rescheduling since setting the process in motion earlier this year.
The hearing will result in a report from the judge on the testimony, after which the DEA can proceed with its final rulemaking process. Legal challenges further drawing out the proceedings are also possible during the 30-day waiting period before those rules become official. Some industry observers decried what they see as an unnecessary delay, but others pointed out that a robust hearing on the issue ahead of rulemaking can head off unforeseen legal challenges or other complications down the road.—Daniel Marsteller
