Texas Senate Advances Hemp Ban to State House

August 5, 2025

Last Friday, the Texas Senate passed Senate Bill 5, banning hemp products with any detectable level of THC. The measure passed 21-8 and now the Texas House of Representatives will consider the corresponding House Bill 5. While HB 5 is currently the same as SB 5, the House bill’s sponsor, Rep. Gary VanDeaver, called the language a starting point from which the House will develop its own language after hearing from category experts.

Before coming before the full House, the bill will be workshopped by the Committee on Public Health. If the ban remains and is approved by the House, it will have largely the same effect as the last attempt to ban hemp-THC in Texas, which Governor Greg Abbott vetoed.—Shane English
